Asbestos Resolution

The Asbestos Resolution Trust Website Home Page represents the Rock Wool Manufacturing Company Asbestos Trust, the Rutland Fire Clay Company Asbestos Trust and the M.H. Detrick Company Asbestos Trust.

The trusts were most recently open for claim filing during the following times:

  • Rock Wool - Nov. 14, 2010 through Jan. 13, 2011
  • Rutland Fire Clay - Nov. 28, 2010 through Jan. 27, 2011
  • M.H. Detrick - Dec. 12, 2010 through Feb. 10, 2011

The trusts are currently considering an open period for new claims in late 2014 or in 2015.

Payment Process

  • The amount to be paid will be based on available funds and the total number of claims.
  • Claims will be paid on a first received priority basis randomized in seven (7) day intervals.
  • Claim payments were made on July 28th for many of the claimants accepted by the Rutland Fire Clay Asbestos Trust.
  • Claim payments were made on September 30th for many of the claimants accepted by the M.H. Detrick Co. Asbestos Trust and the Rock Wool Mfg. Co. Asbestos Trust.

If all the claims you submitted to Rutland Fire Clay Asbestos Trust were not paid on July 28, 2011 or all the claims you submitted to the M.H. Detrick Co. Asbestos Trust or Rock Wool Mfg. Co. Asbestos Trust were not paid on September 30, 2011, please see comment below:

  • Payment of claims will be made over time based on the total number of current claims and the order of claims received.

Payment Accounting to Trust

Within 120 days of the date of the payment letter, the law firm agrees to provide the Trust with an accounting of the claim paid and those that were not paid for any reason, including returned checks, deceased claimants, unknown addresses, etc.

Your firm agrees that it will void the unpaid claims after 120 days of the date of the payment letter and will send a check that reimburses the Trust for all uncashed checks at the Claim Paid Value $100 per claim.

Your firm also agrees to provide the Trust with a detailed accounting of claims by returning the original csv file as an attachment to an email to be sent to trustassistant@resasb.org. The email body should include a summary of the number of uncashed checks, number of returned checks and number of outstanding checks, the total amount of money paid to claimants and the total amount of money reimbursed to the Trust. The original csv file must be updated to include the check status of each claimant and be saved as a comma delimited file before attaching it to the email. The Status should be represented by a single letter code as follows; (C)ashed, (R)eturned, (O)utstanding or (P)artial Cashed {see paragraph below for more information on partial cashed}. The status letter code must be added in the last column, the "Status" column, in the original csv file.

Law Firms that are making multiple payments to deceased claimant beneficiaries should refund the Trust for the uncashed portion of the checks and report back with a Status = "P".
Refund = # Uncashed Checks / # Checks Law Firm Issued x Trust Payment Amount.
Example:
Refund = 3 / 10 x $100.00 = $30.00

Upon request, an extension of time may be granted to process claims payments and accounting as required in the Claim Payment Emails.
